Court reverses town vote to swap Tinkham Forest for 400 acres

MATTAPOISETT -- A court reversed the town's decision to sell conservation land, donated by the Tinkham family 40 years ago, for private development.

Town Meeting voters authorized giving the Tinkham Forest to The Bay Club of Mattapoisett to build 22 homes adjacent to its country club.

In exchange, the developer offered 400 acres....

"Mr. Tinkham had a specific charitable purpose . . . and did not intend for the gift to be freely alienable by the Town," the Judge decided.

Good call. If guy wanted it used for open space. That does not sound like 20 homes around a golf course.
