OK. So this bill would fund the previously existing law, allowing States to properly provide info on who is prohibited from owning a gun.

The opposition would seem to be this: Its fine having a law that isn't being enforced well due to lack of funding. Funding that law is evil.

Am I wrong on this?

OK. What's so bad about that. Courts routinely prohibit people under indictment from owning or possessing a firearm. By having a nationwide registry, we can ensure that these folks don't illegaly purchase a gun and, say, shoot kids in the back of the head.

That is the problem. The 2nd amendment does not say that the right to bear arms shal not be restricted except when we have a liberal congress at which time we will restrict the daylights out of the right.

This also is of the 'guilty until innocent' theory of government.

Most disgusting is the Lautenburg bit. All ti takes to lose ones rights is the accusation of ones spouse in a messy divorce.

Keep the government out of our lives and we would all be a lot more free and happier.

SUMMARY AS OF:
1/5/2007--Introduced.

NICS Improvement Act of 2007 - Amends the Brady Handgun Violence Prevention Act to require: (1) the head of each federal agency that has records relating to persons for whom receipt of a firearm would violate federal or state law to provide that information to the Attorney General for inclusion in the National Instant Criminal Background Check System (NICS); (2) the agency, upon being made aware that the basis under which a record was made available no longer applies, to correct the record and notify the Attorney General; and (3) the Secretary of Homeland Security to make available to the Attorney General records relevant to a determination that a person is disqualified from possessing or receiving a firearm and information about a change in such person's status for removal from NICS, where appropriate.

Directs the Attorney General to make grants to: (1) states and Indian tribal governments to establish or upgrade information and identification technologies for firearms eligibility determinations; and (2) states for use by the state court system to improve the automation and transmittal to federal and state record repositories of criminal history dispositions, records relevant to determining whether a person has been convicted of a misdemeanor crime of domestic violence, court orders, and mental health adjudications or commitments.

Requires: (1) the Director of the Bureau of Justice Statistics to study and evaluate NICS operations and to report annually to Congress and to specified states regarding best practices; and (2) the Comptroller General to conduct an audit of the expenditure of all funds appropriated for criminal records improvement to determine how the funds were expended.

You are incorrect. The current law permits the TEMPORARY order to contain prohibition on firearm possession. I quote from the manual put out by the courts [url=http://www.courts.state.me.us/courtservices/guide_protect_abuse.pdf]here....

any firearms or dangerous weapons, if [b]the complaint demonstrates[/b]

prohibits possession of dangerous weapons other than firearms, the order
will specify what weapons are prohibited. A defendant prohibited
from possession of firearms or other dangerous weapons must turn over
any prohibited items to a law enforcement officer or other person within
the time stated in the temporary order (24 hours or less after the temporary
order is served on the defendant).

So, just on the plaintiff's say so, the court can enter an order IMMEDIATELY stripping you of your second amendment rights. They can put you out of business, if you are a gun dealer or cop. I once defended a cop whose wife was, unfortunately, schizophrenic. She got a temp order, in a case so laughable that I finally got attorney fees -- unpayable because she was crazy.

The temp order deprives you of a fundamental right without due process of law, in my book. It does so in spades, where one has previously demonstrated conpetency and good moral character (like post LEO background check or concealed firearm permit issuance).

I find it disturbing that anyone in Maine who has a restraining order slapped on them has no right to keep or bear arms. Do you realize how easy it is to get a "restraining order" on someone? All your anti-gun neighbor has to say is "He's scary, I'm afraid he might come over and hurt me, because he looks mean." and some Anti-Gun Judge could slap a restraining order on you for nothing, and permanently steal your 2nd Amendment Rights. Guilt before innocence in modern day America.

A possible shift in emphasis, Roger: it's a Constitutional rights issue. The states may not abrogate to themselves powers reserved to the Federal Government by the Constitution. The right to posess & bear arms is a guarantee under the Federal Constiution. Simple [i]alledged[/i] malfesance should never be allowed to deny an individual's Constitutional rights.
