"The powers of the president...will not be questioned."

These are very disturbing words indeed:

Our opponents, the media and the whole world will soon see as we begin to take further actions, that the powers of the president to protect our country are very substantial and will not be questioned.

So said Stephen Miller, a senior advisor to Donald Trump, on Face the Nation this morning.

I'm curious how many AMGers will let this statement pass. AMGers that I know would have been outraged if this was an advisor to Barack Obama.

The President has no power

The President has no power other than that the Congress and the Constitution gives him. Under the Constitution as originally written only the Congress has the power to deny citizenship or permanent residence to foreigners. I do not recall or believe there is any law passed by Congress prohibiting foreigners from legally residing in the United States. Further, if you read the Constitution, Article 1 Section 9, it states "the migration or importation of such persons as any of the states now existing shall think proper to admit shall not be prohibited by the Congress prior to 1808......." This clause was added to the Constitution to specifically give the Congress the power to prohibit the importation of slaves which it has never done. In exchange the slave states were given a disproportionate representation in the Congress. This compromise later caused the need to pass another compromise law, the Fugitive Slave Act that required the non-slave states to return escaped slaves to their owners. As new states were added to the Union the slave states lost their power in the Congress but still had to pay their share of taxes. Their income was however dwindling because they could now produce their output for less labor cost due to the invention of the cotton gin but were still required to house and feed their now surplus slaves. This invention freed the slaves but not their owners and the result was the Civil War.

All of these compromises ultimately made a farce of the clause just cited and in its place the Congress ignored it and established a quota system which was purely discriminatory and beyond the power given them by the Constitution except for the provisions of the cited article but gave the President latitude in which of the unconstitutional and discriminatory provisions he chose to enforce. The latter is itself unconstitutional because it is a delegation of power by the Congress that they are prohibited from enacting because it is outside their powers which are limited by Article 1 Section 8.

All of this is moot because since the 1819 decision by the Supreme Court the Congress is now legally permitted to do anything that is not specifically prohibited and they have been quietly but inexorably whittling away at those prohibitions.

In any case, Stephen Miller's statement is a non event because if the executive oversteps their bounds, they'll get bitch-slapped by the power of the judiciary. No one believes in limiting the power of the executive more than Gorsuch, and I expect that during his confirmation hearings you'll hear a lot of questions surrounding limiting executive power.

I read millers statement and I don't see anything objectionable. He seems to be saying Trumps EO will be reviewed and upheld

It may be incorrect as a prediction but I don't see lurking tyranny in it.

doofus??? The last fractured snowflake I knew to use that term was caught stealing a tape deck on school property. Unfortunately for him, the Vets who were going to school there were the ones who caught him. I learned later that he fractured both kneecaps falling on the grass when he tripped over his own two left feet while waiting for the cops. He did get ejected from the school. Something that should happen on a much more regular basis today.
