SEIu's 'union culture" has been clearly defined and established.......here in this thread! Belcher claiming ownership of 'Union Culture' or even any knowledge of it, is another one of his mental conditions! Well it is good to see MSEA making some noise over the contracting out of services at State Parks, However no charges or grievances have been filed for protection from impact! However the MTA employees GOT NOTHING when Peter Mills dumped twenty of them continuing the structured demise of the breathing in favor of increased EZ Pass! EZ Pass (automation) IS a mandatory subject of bargaining which was slipped past sleeping SEIu back ten years ago or so! SEIu should have filed discrimination charges when the two tier toll rates were established charging "people" users more for driving the same highway miles as the 'robot' users! SEIu money for nothing and laughing all the way! Belcher, DeAraujo and the SEIu legal team or Hear No, Speak No, See No Evil (violations of member's rights) incorporated!

Thanks, but there is no need. Where and how the work is done is the impact which is mandatory for even the State to bargain. Discontinuence of positions requires bargaining the impact to those displaced such as early outs etc. But then everyone knows that except those brainwashed not to and arrogant enough to think they are the authority, BL I enjoy your attacks as they set the example for prenatal care!

Errrr...Back to Blue was referring to the State's statutory duty to bargain the financial impacts of layoffs.
Sure the State has the right to lay employees off....but it cannot lay employees off and contract out their work without bargaining the financial impact of that action.
Unless of course the employees' labor union(s) are asleep at the switch or worse.
Surely a smart guy like you would know the difference between a contactual violation (remedied by grievance) and a statutory violation (remedied by complaint).
II. CATEGORIES OF BARGAINING
A. Mandatory Subjects of Bargaining
Mandatory subjects of bargaining generally fall squarely into the ambient of "wages, hours, and terms and conditions of employment."
Public employers have a duty to bargain about the decision to make the change and the effect of the change on the employees.
The duty to bargain about the effect of the change on employees is called impact bargaining.
Refusal to bargain these mandatory subjects is a per se violation of the PERA.
B. Permissive Subjects of Bargaining
Subjects which do not fit into the ambient of "wages, hours, and terms and duties of employment" are permissive subjects of bargaining.
Public employers have a duty to bargain about the effect of the change (impact bargaining), but not the decision to make the change.
C. Illegal Subjects of Bargaining
A relatively small number of topics have been found to be unlawful to bargain as the effect of their implementation would violate law or public policy. [Eg. A contract provision which required all employees, including non-union members to contribute a portion of their sick leave to a "union time pool" was unlawful because it interfered with a nonunion members right to refrain from participating in union activities. Delaney V. City of Hialeah v. AFSCME, Local 3032, 9 FPER 14,339 (1983), aff'd, 10 FPER 15,300(1984)
III. IMPACT BARGAINING
Thus, impact bargaining is the employer's obligation to
bargain over the effects of unilateral management decisions
regarding areas of permissive, bargaining.
Taken from collective bargaining regulations, as an FYI for those who are unaware!
Of course the fact that the union agrees to them sort of nullifies the requirement.
I.E. the famous 17% loss, the union agreed to it vs. layoffs,hence no complaint!

State workers, as the news has reported Govenor LePage's big secret meeting has nothing to do with state jobs, bargainning or MSEA. Word around the state office building is that the republicans are not happy with their governor and that they are not playing games this close to election time.
I was told that wrong information was posted earlier on this webpage. I was told that a complaint was filed to MLRB regarding the state's refusal to bargain and this complaint was accepted as a valid complaint in May by MLRB. It was reported on this site that the complaint was dismissed by MLRB. I have not heard if there has been a hearing. I suspect this may be one good reason why Fair Share became a dead issue with the state (governor). Listen to the news or speak to people that know what is happening before feeling threatened by what is being printed on this thread. Wrong information is being shared.

Congratulations to the Legislature for 'slapping' LePage around, and 'killing' the special (phantom) session! When confronted by the media LePage was dazzling with his demonstration of mastering the English language with his eloquent "NO COMMENT!" It appears as though SEIu can come out from under the Family Planning 'Bed' and flex its muscles on how it managed that problem of pending doom! Some worms do slither off the hook!

I too congratulate the DHHS Caseworkers for a job well done with negotiating a higher salary. And I agree that the governor put his foot in his mouth and those legislators that stood up to the governor deserve recognition. However, I hope people vote smart in November. As most news watchers are aware some predict that the governor has placed a nail in the coffin of these legislators that are republican seeking re-election. I am still trying to figure out why the governor would hurt the republican party this close to elections?
Now the reports are that the democrats will be reelected to stop LePage from continuing to spiral out of control and hurt not only public employees, but the poor, handicapped, children's services, unemployment, etc. At least legislators stopped the governor from cutting a few positions at DHHS while planning his BIG reorganization. Remember the governor has cut over 80 positions and created 72ish positions. It is my understanding that he is not offering positions to those that are being cut.
The Governor states that he has an open door policy for Maine's citizens. I am aware of a person that met with the governor quit sometime ago and this person had knowledge of what was happening in state agencies. Unfortunately the governor did not carefully listen or investigate information shared at this meeting and did nothing to resolve very important and cost effective resolutions for the citizens of Maine. So don't waste your time with the governor's open door policy meetings. Submit your complaints directly to your legislators.

A good slap when citizens are suffering is not such a bad idea. The governor needs to better invest his time working for our state and create some jobs with benefits. Remember, the governor wanted to hurt all public employees and he wanted the legislation to give his appointees better benefits, etc (sweeten their pots). Luckily the legislators said NO!
Correct me if I am wrong, but his appointees are the highest paid employees that are being paid by tax payers. Correct me if I am wrong but many are his friends, family members and some forced to leave because they may have burned down an apartment building or two that was being foreclosed on or maybe somebody was arrested for DUI.
Does the govenror's public relations person look angry when she is being interviewed, stressed, depressed? Granted she does not have an easy job. I am afraid that soon her nose will begin to grow!

You're right...direct dealing is unlawful and any labor union worth its salt would challenge this...
But msea-SEIu Local 1989 is not worth its salt....so I don't blame these workers for direct dealing.
Because they're caught between a rock and a hard place.
That is they can unlawfully direct deal with management and get a raise....
Or they can lawfully sit back and hope Rat Rod Hiltz and company get them a raise...
Instead of the usual excuses and stories about how he was the Norma Rae of the Paper Mills.

Many State Workers are underpaid,have poor moral and tremendous turnover in their workplace. Kudos to the Child Protection Case Workers, some of whom got a 9% raise, BUT, they are NO BETTER, than others just as deserving! LePage was 'in on this strategic move' with Mary Mayew, who if you recall, had millions of dollars in shortfalls because her computer programs paid Maine Care benefits to folks who were not entitled to receive such benefits. So a Half Million Dollars or so in discriminatory raises for a select group (close to LePage's end family violence push) seems more to meet the Governor's needs than those of State Workers! But watch SEIu do nothing!........the Member's are used to nothing and that's what they will get!
B to B, I agree that the family violence push is one good reason and the other is that he is reorganizing childrens services. Employees working for the state are tired of no raises and LePage not keeping any of his promises. The republican chairperson, Mr. Webster said on the news a few days ago that the fisherman and loggers will appreciate the governor's approach. Hello, Maine's fisherman and loggers are greatly suffering like everybody else. It is difficult for loggers and fisherman to buy fuel for boats and equipment and fuel just keeps going up.
I agree raises for caseworkers may have been negotiated by Mary Mayew. It is difficult to recruit and keep social workers/case managers on staff due to the overwhelming workload and low paying positions. Caseworkers are Social Workers and Social Workers in the private sector make a much larger salary. Now that retirement and benefits are cut why should social workers remain with the state. When the governor starts slashing benefits and the state are already underpaid compared to private sector jobs, it becomes increasingly difficult to keep good people.
MSEA should be assisting DHHS and yes all other employees with benefits, salaries, etc even if this means filing a law suit. A good time is the new year when there has been a change in legislature. I am guessing that the majority will return to democrats.
Of course all this amounts to is fodder for arguments for and against but it doesn't recognize that such upgrades/reclassifications of positions is done all the time out side the contract process!
A union may agree to it but it is done outside of the contract via human resource policy and procedures. All a department has to show is they have the money to do it w/in budgeted resources.
B.L., I agree that jobs are reclassified outside of the contract process. Employees can submit a reclassification if they believe their position should be reclassified. I am happy for the caseworkers at DHHS that their jobs were upgraded but I hope that other employees will receive raises and the pension plan be restored for our retirees. I agree that unions may not have a role in reclassifications unless the member requests assistance.
I hope this administration stops playing games with citizens and stops trying to scare our most vulnerable citizens with threats of top secret meetings.
